Pick Up & Return Details
Unless other arrangements are made in advance:
Pick up time is between 9:30am and 4:00pm on 4/20/2024
Return time is between 9:30am and 4:00pm on 4/20/2024
Late return will be subject to a fee equal to an additional day.
Equipment must be returned clean or be subject to a cleaning fee of $75/hour. Vacuuming and sanitizing is built into the cost of your rental, but mud, food, dog poop, glitter, confetti, balloons, and other messes take additional time and money to clean, for which there will be a charge. It is recommended that you take pictures after cleaning, in case there are any disagreements. Wet grass and/or a small amount of dirt on the bottom of the inflatable (not the interior floor) is fine, just don't leave caked on mud or dog poop. Do not use Silly String in or around inflatables. Use of water (sprinkler, hose, adjacent to a pool, etc) on an item not designated for water will result in a fee of at least $100.
Damage, other than normal wear and tear, will be the responsibility of the renter.
Power requirements are the responsibility of the renter. Information about power needs can be found at the bottom of this contract, with further explanation on our website (portlandpartyworks.com), or by calling us at 503-723-8300. Blowers generally require a dedicated 20 amp circuit in order to operate trouble free.
Vehicle size is the responsibility of the renter. Generally a full-size SUV or truck is required. Please ask for specifics on your item before picking up with a smaller vehicle.
Terms & Conditions
Setup and Use: Inflatables can be extremely dangerous if not used properly, but are very safe when installed properly and rules are followed. All equipment must be installed and anchored properly, and must remain under adult supervision at all times. Proper anchoring of inflatables includes using provided stakes or sandbags, driving stakes all the way into firm ground, or attaching sandbags to anchor points. Instructions are provided via video links in email, and are also available on our website. Our warehouse staff can also provide written instructions. It is the customer's responsibility to ask for more info if anything is unclear, or if videos cannot be accessed. Rules are posted on every inflatable, and are expected to be followed for the safety of participants and the equipment. Basic rules include limits to the number of users at one time, rough play, food, shoes, and sharp objects, and climbing on walls and netting is not allowed, as well as other rules specific to each item.
Equipment: Items pictured on website may not be an exact match with the item you receive. We are constantly replacing items, and in some cases we have multiple similar items. If you are relying on an exact match or color scheme that you saw on our website, be sure to let us know about those needs prior to signing this contract. Customer is responsible for the safe use and security of items during the rental period, and will therefore be held responsible for repairs or replacement cost resulting from damage or theft.
Payments, Reservation, & Use Terms: A non-refundable deposit and an authorized signature on your contract will reserve your activities and date. Unless otherwise specified in the "Event Notes", the balance is due at least one day prior to your pick up date. We reserve the right to set appropriate rules of conduct and age/weight/time limits in order to best facilitate your event and maintain a safe environment. Unless other arrangements are made, we will run the balance on the card used for the previous payment.
Cancellation Policy: This section may be modified in the event notes, which are specific to each event. We offer a flexible cancellation policy and offer full credit on most events that are canceled/postponed at least 3 days out from your event. Starting up to 3 days prior to your event the paperwork and pulling of inventory begins. For these reasons all cancellations and/or changes to your order that take place less than 72 hours prior to your event will have a fee. The remainder of any prepayments may be used towards re-booking another event within 1 year.

Weather policy: Some of our equipment cannot be used in certain weather conditions. Examples: Most inflatables cannot be used in winds exceeding 15-20mph, Electronics, casino equipment, and table games such as foosball or billiards cannot be used in rain. When prohibitive conditions are in the forecast, a representative from PartyWorks/Wild Bill's may contact you in an attempt to avoid fees in the event of cancellation. The renter is responsible for paying attention to weather conditions which might affect their event, and communicating any concerns. We will always attempt to provide alternative equipment to fit your needs. If your rentals are cancelled by PartyWorks/Wild Bill's due to weather, 100% of payments can be used toward another rental for up to 1 year. Re-scheduling of rentals is based on availability; we will make every effort to accommodate re-bookings. Re-bookings can be for the same or different rental items. No inflatables, even those with a "roof", are to be considered waterproof; if they are setup in the rain, they will be wet throughout and no refund or credit will be offered.
Hold Harmless Provision: Lessee recognizes and understands that use of Lessor's (PartyWorks) equipment may involve inherently dangerous activities. Consequently, lessee agrees to indemnify and hold lessor harmless from any and all claims, actions, suits, proceeding costs, expenses, damages and liabilities, including reasonable attorney's fees arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of said equipment including, but not limited to the delivery, possession, use, operation, or return of the equipment, unless lessor is operating the equipment and is deemed by a court of law to be negligent in its actions. Lessor cannot under any circumstances be held liable for injuries as a result of acts of God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless lessor from any loss, damage, theft, or destruction of the equipment during the term of this contract and any extension thereof, except for those attributable to negligent acts or omissions by Lessor, its principals, directors, officers, agents, employees, volunteers, and insurers.
Merger Clause: This signed contract contains the entire agreement between the Lessor and the Lessee. No amendment, whether from previous or subsequent negotiations between the Lessee and the Lessor, shall be valid or enforceable unless in writing and signed by all parties to this contract. The invalidity or unenforceability of any particular provision of this contract shall not affect the other provisions hereof.
Equipment Breakdown: In the event of an equipment failure or breakdown, immediate notification to a PartyWorks representative must be made. Failure to notify PartyWorks at the time of equipment failure will deem the equipment in proper working order for the event. PartyWorks staff will make reasonable efforts to get the equipment up and running as quickly as possible. In the event PartyWorks is responsible for a failure, your sales rep will work with you over the following days to find an amicable solution; on-call staff cannot make any agreements regarding compensation. Outside of regular business hours, you can reach our emergency line by calling 503-723-8300 and following the prompts.
It's important to note that wear & tear, basic cleaning, maintenance, warehouse labor, etc. are built into the price of each item. This means that one hour of downtime in a four-hour event, does not equate to 25% of the rental price. As a general rule, assume that 60% of the cost covers the first hour, with each additional hour accounting for 13.3% of the cost. For will call rentals, be sure to set your rentals up well before your event start time. If there is a problem, it may take some time to correct it. Please do not expect compensation if we are able to help you correct the problem within a reasonable amount of time.
If every single hour is equally important to your event, please make that clear up front, so that we can price it appropriately. While we strive to keep equipment running throughout your event, breakdowns do happen; we feel it's best to be prepared, so that everyone knows what to expect. Let your salesperson know if you have any questions or concerns.

For events outside the Portland/Metro area; if setup is required before this designated time, there will be additional charges to cover staff time. Unexpected incidences such as accidents in transit, mechanical breakdowns or safety considerations, etc., may occasionally cause a delay in the agreed upon set up time. Important Information About Oregon Casino Fundraisers (PLEASE READ CAREFULLY):
Casino fundraisers are regulated by the Oregon Department of Justice.
For licensed and (unlicensed) Monte Carlo activities, the first qualifying criteria of holding tax-exempt status (under IRC 501©) must be met and such status must have been held for not less than one year preceding its application for a license. Compliance with OAR 137-025-0310’s Monte Carlo disclosures contain information important to purchasers and can help prevent or resolve any subsequent complaints.
If proceeds from the activities of the casino alone are not expected to exceed $2,000, a license is not required. However, the Department of Justice still has jurisdictional oversight authority and routinely investigates, regardless of whether the activity is licensed or exempt from licensing requirement.
If proceeds of the casino are expected to exceed $2,000, be sure to check the Department of Justice website for a listing of current required licenses and fees.
No one under the age of 18 years may participate, in any way, in the casino activities. This includes, but is not limited to, selling scrip, standing or sitting at the tables or in any way handling revenues from the casino activities.

Delivery W/O Staff Details
You have chosen the option of "Delivery Without Staff". With this option, we will deliver and set up each piece of equipment, and you, the customer, will be responsible for many of the tasks that would otherwise be handled by PartyWorks Event Staff, including but not limited to: Making sure equipment is being used safely and is being properly cared for, identifying power issues to determine whether a power cord, extension cord, breaker, or outlet is at fault, cleaning air hockey surface and smoothing pucks during use, putting pieces of equipment back together if it is broken during use, adding air to sealed-air items such as Zorb balls, adding fuel to generators, restarting a generator, and many other tasks that might come up. We will do our best to inform you about issues that might come up, but with thousands of pieces of equipment, and a constantly changing inventory, this is difficult, so please ask us if you have any questions about your rented equipment. Virtually every problem can be easily solved through basic troubleshooting by someone who is mechanically inclined. This option is best suited to do-it-yourselfers; if that is not you, please speak to your salesperson about adding PartyWorks Event Staff to keep everything up and running.
Delivery window (the time we are planning to arrive) is currently set to 4/20/2024 2:00pm - 6:00pm. If this is incorrect, or if it needs to be narrowed down prior to the event, please let us know. Unless otherwise specified in the "Event Notes", our only guarantee is that we will complete setup prior to the event start time.

Do not use Silly String in or around inflatables. Use of water (sprinkler, hose, adjacent to a pool, etc) on an item not designated for water will result in a fee of at least $100. If your rentals are cancelled by PartyWorks/Wild Bill's due to weather - including road/travel conditions - 100% of payments can be used toward another rental for up to 1 year.
Hold Harmless Provision: Lessee recognizes and understands that use of Lessor equipment may involve inherently dangerous activities.
In the event PartyWorks is responsible for a failure, your sales rep will work with you over the following days to find an amicable solution; event staff cannot make any binding agreements regarding compensation.
It's important to note that setup, teardown, basic cleaning, maintenance, etc. are built into the price of each item. This means that one hour of downtime in a four-hour event, does not equate to 25% of the rental price. As a general rule, assume that 60% of the cost covers the first hour, with each additional hour accounting for 13.3% of the cost. Additionally, if your event is 8 hours long, but you're only being charged the four-hour price, the allocation for each additional hour will be much less than 13%.
Outside of regular business hours, you can reach our emergency line by calling 503-723-8300 and following the prompts.

If Wild Bill’s has to add on additional setup personnel due to not enough setup time, there will be a $100 additional charge to the client. For events outside the Portland/Metro area; if setup is required before this designated time, there will be additional charges to cover staff time. Unexpected incidences such as accidents in transit, mechanical breakdowns or safety considerations, etc., may occasionally cause a delay in the agreed upon set up time. Requirements: The host will be responsible for acquiring suitable premises to hold the event, including adequate square footage as listed above.

PLEASE NOTE: Equipment or entertainment shall not be considered reserved until the rental agreement has been signed, deposit has been paid, and payments are up to date according to the following schedule: 33% of the total invoice must be paid by February 15th, 66% by April 15th, and the full balance at least two weeks prior to your event date.

- Between April 16th - May 15th: Forfeit 60% of that item's cost.
- After May 15th: No credit or refunds on cancellations.
Multiple item cancellations may be accepted, but that is up to PartyWorks' discretion. Popularity of the item, and whether or not we can add it to another event will be the primary determining factors in this decision.
Inclement Weather Policy: If an event is altered due to inclement weather, PPW will suggest an alternative equipment piece to replace contracted equipment in grad package, whether a la carte or all-inclusive.
Failure To Provide Equipment Package: Unexpected incidents such as accidents in transit, mechanical breakdowns, etc., may occasionally necessitate the cancellation of a piece of equipment. Based on past experience, failures of this type occur less than 1% of the time. In any occurrence PPW will use their best discretion to trade out/replace equipment or entertainment.
In the event PartyWorks is responsible for a failure, your sales rep will work with you over the following days to find an amicable solution; event staff cannot make any binding agreements regarding compensation.

Access Terms: Portland PartyWorks coordinator and grad party committee representative shall coordinate with venue regarding accessibility (i.e. doorways, elevators, stairwells, outside entrance access, limited access and other obstacles) to required space where the equipment will be placed.
Power: Portland PartyWorks coordinator and grad party committee representative will evaluate appropriate power requirements for contracted entertainment and equipment. Generators are available for rent should there be any concern over inadequate power at a venue. If generators are not rented or added on the rental contract and equipment cannot run because of a lack of power there are no refunds due to lack of adequate power provided by event venue. The equipment on your contract requires approximately 0 20amp electric circuits within 75 feet of equipment placement.
Volunteers: Grad committee is expected to supply and be liable for the number of volunteers agreed upon. A trained PPW staff will give safety parameters for each game prior to start of events. It is imperative that all games are properly staffed with required volunteers at all times. Portland PartyWorks supervisor, coordinator and staff reserve the right to shut down any volunteer run activity that is not being supervised properly.
Waiver of Liability: Portland PartyWorks is a fully insured company holding complete liability insurance coverage for its interactive package equipment. In consideration of all night graduation parties contracting with Portland PartyWorks, grad committees voluntarily release, indemnify, hold harmless and discharge Portland PartyWorks, its coordinators, supervisors, employees, staff, owners, managers, volunteers and insurers from any and all liability, claims, demands, and actions. We, the volunteer graduation committee and its student participants understand that the activities engaged in all night grad events bring with it both known and unanticipated risks of injury to participants to include, and not limited to falling, slipping, crashing, colliding and could result in injury, illness, disease, emotional distress, death and/or property damage.
Partial Cancellation/Entertainment Changes: We want our customers to be happy and receive exactly what they want for their special event. Please understand, though, that the grad season is very busy and in order to reserve the items you want for your event we have to secure things such as the venue, food and outside entertainers with non-refundable deposits at the time of booking. If you decide to make a change after items have been booked we will do our best to accommodate you, however, we cannot guarantee a refund on items cancelled or changed.

Access Terms: To address specified by customer, customer grants right to enter said property for the delivery and pickup of the rental equipment at approximately specified times. Client is responsible in the case that vehicle(s) are unable to enter or entrance is delayed. Once PartyWorks/Wild Bill's arrives at event address any changes to event address may result in additional travel charges, reduced event run-time and/or cancellation of the event. Many items require clear access to setup location, minimum four (4) foot wide clearance, and grades less than 5%. Depending on the equipment rented, indoor setups may require double doors with the center pole removed or roll up doors with a minimum 4 foot wide clearance, and setup locations may need to be accessible without the use of stairs. Setup locations that require the use of an elevator may be difficult and therefore, must be disclosed in advance. Failure to notify PartyWorks/Wild Bill's of setup locations with limited access as defined herein may result in a reduced rental period and/or cancellation of event or rentals with client responsible for the entire balance of this contract. Area where items will be placed must be clean and cleared of obstructions before we arrive. Client is responsible for answering all follow up questions about access conditions accurately, or items may not be delivered and a refund may not be offered.
>
Parking:If the event is being held at a venue where free parking is not readily available, validated parking or passes are to be provided for event staff. If client or venue does not validate parking, a surcharge of $15 per staff person will be added to the final invoice.
Cancellation Policy: This section may be modified in the event notes, which are specific to each event. Once your equipment has been reserved, via signing your contract, paying a deposit, and/or making payment arrangements, any cancellations may be subject a fee, listed below as a percentage of the rental total. After fees are subtracted, any remaining prepayments may be used toward re-booking another event within 1 year. No refunds on prepayments. Cancellation fees are waived if event is canceled due to a government mandated shutdown. To receive full credit, PartyWorks must be notified by client of intent to cancel immediately after government shutdown is announced.

Hold Harmless Provision: Lessee (customer) recognizes and understands that use of Lessor's (PartyWorks) equipment may involve inherently dangerous activities. Lessee also agrees to indemnify and hold harmless lessor from any loss, damage, theft, or destruction of the equipment during the term of this contract and any extension thereof, except for those attributable to negligent acts or omissions by Portland PartyWorks, its principals, directors, officers, agents, employees, volunteers, and insurers.
